CONCERNING
THE EXEMPTION FROM IMPORT DUTY ON SEVERAL KINDS OF SPARE PART OF PUBLIC TRANSPORTATION

THE MINISTER OF FINANCE,

Considering:

• a. That is in the framework of fulfilling the need for spare part for affordable maintenance of public transport facilities, it is deemed necessary to exempt several kinds of, spare part easy to wear out from import duty;
• b. That is based on the consideration as meant in paragraph a, it is necessary to stipulate a regulation of the Minister of Finance on the Exemption from Import Duty on the Import of Several Kinds of Spare Part of Public Transportation;

Referring to:

• 1. Law No. 10/1995 on Customs Affairs;
• 2. Presidential Decree No. 20/P/2005;
• 3. Decree of the Minister of Finance No. 545/KMK.01/2003 on Stipulation of system Of Classification of Imported Goods;
• 4. Decree of the Minister of Finance No. 547/KMK.01/2003 on Stipulation of Tariffs of Import Duty on Imported Goods;

DECIDES:

To Stipulate :

THE REGULATION OF THE MINISTER OF FINANCE ON THE EXEMPTION FROM IMPORT DUTY ON SEVERAL KINDS OF SPARE PART OF PUBLIC TRANSPORT

Article 1

(1) The import of motor - vehicle spare part consisting of :

• a Transmission assembly as many as 50.000 units
• b Engine assembly as many as 50.000 units
• c Ban type as many as units
• - 11 R 22, 5 16 PR as many as 20.000 units
• - 295/80 R22, 5 as many as 5.000 units

(2) Kinds of the goods as meant paragraph (1) Shall be imported in a new condition

(3) The Minister of Transportation Shall stipulate the public transport companies and allocation of the imported gods as meant in paragraph (1)

Article 2

Applications for obtaining the relief of import duty as meant in article 1 paragraph (1) shall be submitted by the public transport companies as meant in article 1 paragraph (3) to the Director General of Customs and Excise with a copy made available to the Director General of Land Transportation and the Director General of Foreign Trade.

Article 3

The Director General of Customs and Excise on behalf of the Minister of Finance shall issue a decree of the Minister of Finance on the exemption from import duty as meant in Article 1.

Article 4

The Director General of Customs and Excise shall regulate further the implementation of the provisions in this regulation.

Article 5

The Regulation shall come into force for 12 (twelve) months, starting from March 10, 2006.

For public cognizance, the regulation shall be published by placing it in State Gazette of the Republic of Indonesia.
